DATA PROTECTION INFORMATION

Use and sharing of applicant profiles by HelvePark, purpose limitation

The application portal ("application portal") of the company named below ("HelvePark ") enables applicants (male/female/male) ("users") to apply for advertised positions. Applications are processed on the application portal for the following company:

The personal data entered by users in the application portal (see the fields in the profile of the online application form, whereby only the fields marked with a "*" are mandatory) are collected, processed, and used by HelvePark exclusively for the application process and for filling the advertised position (purposes of processing).

The answers entered by users to the question "How did you find out about HelvePark?" are used in an anonymized form for statistical evaluation beyond the application process.

Only the employees (m/f/d) entrusted with filling the advertised position (“Employees”) have access to the (personal) data provided by the users. 

When applying for an advertised position, the (personal) data provided by the user is only accessible to the HelvePark employees entrusted with filling the advertised position and is processed by them.

Management of application profiles

Applying for a position is possible without registering on the application portal. In this case, the user is provided with a link by email (confirmation email) via which an account can be created on the application portal (but does not have to be created).

If an account is set up on the application platform via the link, users can access their application profile at any time. Users can access the (personal) data they have entered at any time and can view it at any time.

Users can update their contact details at any time. However, the documents and information provided for the applicant profile cannot be updated/deleted by them themselves (but only via HelvePark - see below). Furthermore, users can upload additional documents to the application portal at any time. Users must be aware that a change in contact details will affect all their current applications at HelvePark.

 

If a user is no longer interested in the advertised position, the application can be withdrawn at any time in the application portal itself. This user will then no longer be considered a possible candidate (m/f/d) for the position.

HelvePark can contact users to ask whether they are interested in becoming a member of the applicant pool. This applicant pool contains former applicants (m/f/d) who, regardless of the specific position, want to work at HelvePark and have been invited to the pool by HelvePark ("applicant pool"). By being included in the applicant pool, the user can be contacted by HelvePark for (further) positions that match their knowledge and/or experience. If the user is no longer interested in participating in the applicant pool, participation can be withdrawn at any time in the application portal. 

Deletion / retention periods

When applying for an advertised position, the application data, documents, user account and other personal data of the applicant (m/f/d) will be permanently deleted 6 months after the application process has been completed. The application process is completed at the moment when the applicant (m/f/d) (i) is hired by HelvePark or (ii) has received a rejection from HelvePark. If the user has withdrawn the application themselves, the data will be deleted after 7 days .

If the user has given their consent to be included in the applicant pool, the application data, documents, user account and other personal data will be deleted from the applicant pool 36 months after being included in the applicant pool.

If the user has been included in the applicant pool and then leaves it again, the application data, documents, user account and other personal data will be deleted 6 months after the application process has been completed or - if older - immediately.

Protection of the application profile against misuse

HelvePark takes security precautions to protect application data against manipulation, loss, destruction, or access by unauthorized persons as well as unauthorized disclosure. HelvePark adapts the security measures to technological developments. The data transfer between the user's web browser and the application portal takes place via an encrypted HTTPS connection (transport encryption).

Hiring

In the event of a hire, the application profile is not transferred to the respective administration system of the HR department of the employing company, but is collected again as part of the hiring process.

Applications from employees

In addition to this data protection information, the company's data protection regulations apply to employees. The applicant pool is not available to employees; information about alternative development tools for HelvePark employees is provided by the respective manager.

JobAgent

The JobAgent can be subscribed to as a newsletter on our website. To check whether the owner of an email address has registered to receive this newsletter, we use the "double opt-in procedure". The newsletter is only successfully subscribed to if the owner of the email address has previously expressly confirmed the activation of the newsletter by clicking on the link in the confirmation email. As proof, we log the implementation of the individual stages of the double opt-in procedure.

We use statistical procedures as part of our newsletter dispatch. We use this data exclusively for the statistical analysis of our newsletter dispatch.

If you register to receive our JobAgent newsletter and thereby consent to its dispatch, your data will be used exclusively for the newsletter dispatch. You can revoke this consent at any time. There is a corresponding link in every newsletter. When you unsubscribe from the newsletter, we delete your personal data from our database. Even without unsubscribing, your newsletter subscription automatically ends 36 months  after registration. You are welcome to subscribe again at any time.

The data is used only for technical purposes and is not accessible outside the technical administrators.

What are cookies and why do we use them?

Cookies are small text documents or pieces of code that contain a unique identification code. Cookies store information such as your preferred language or other personal page settings. If you visit the application later, your browser sends the stored cookie information back to the application. This allows individual information that is suitable for you to be displayed. Among other things, cookies ensure that you remain logged in to a website during your visit and that the website works smoothly.

What type of cookies do we use?

We only use technically necessary cookies so that the website works properly.

Which cookies are used specifically?

Session cookie: This is used to identify the user during the ongoing interaction and is automatically deleted when the browser window is closed. The session cookie is used more specifically for the following points:

Assigning an application to a browser during the application process.

Assigning to a user in the system ("I am logged in as Max Mustermann").

Applicant cookie: The applicant cookie is checked/set when accessing the application portal. It is used to create an evaluation of which website the users were directed to the application from. It can also be determined whether these users have completed their application via this website. The applicant cookie is created for one week and is only evaluated internally and is not passed on to third parties. Like any cookie, it can be deleted at any time via the browser.

Banner cookie: This cookie is set as soon as a user has clicked on the banner. This means that the banner is no longer displayed for this user. The cookie saves the status of the banner for one year. This means that the banner appears again after one year at the latest.

Embedded videos

Job advertisements can contain external content from YouTube that supplements the respective job advertisement and is provided by HelvePark. As part of the technical provision of this service, it is technically necessary that the IP address of your device is transmitted to YouTube, as this is the only way the content can be displayed. If you agree to the transmission, you can play the video by clicking on the play button. If you do not agree, do not load the external content; the website is technically set up in such a way that in this case the IP address is not transmitted to YouTube. We use various technical devices to display the website in your Internet browser so that all content is always up to date. To improve your user experience, in particular the loading speed of the website, at all times, we also use technical service providers who enable us to provide the content required to display the website (so-called "content delivery networks" or CDNs for short). These technical CDN service providers act on our behalf and are bound to our instructions through corresponding agreements. The data collected in this way is only used to display the content of the website in your Internet browser and is immediately deleted after being temporarily stored as part of the delivery.

For technical reasons, every time you access a website, your Internet browser automatically transmits information to our web server (so-called log data). We store some of this information in log files, e.g.

The above log data usually does not contain any personal data. We only evaluate log data when necessary, in particular to resolve faults in the operation of our website or to clarify security incidents. We store this log data without time limit.

However, to resolve faults or to secure evidence in the event of security incidents, it may be necessary for us to also collect the unabridged IP address of the end device along with the log data. We delete this data as soon as the fault has been resolved or the security incident has been conclusively clarified or the purpose of processing has ceased to apply for other reasons. If permitted and necessary, we will pass on log data to investigative authorities in individual cases in the event of a security incident.

We store the above log data separately from other data collected when using our website. We base the above-mentioned data processing operations on legal authorization in accordance with the Data Protection Act - basis for data processing in Art. 4 Para. 3 DSG and Art. 13 DSG.

Your rights

Your right to information about your data: Upon request, we will provide you with information about the personal data we have stored about you. Your right to correction or completion of your data: We will correct incorrect information about you if you inform us accordingly. We will complete incomplete data upon your notification if this is necessary for the appropriate processing of your data. 

Your right to deletion of your data: Upon your request, we will delete data we have stored about you. However, some data will only be deleted after a specified retention period, for example because the law requires us to retain the data in some cases or because we need the data to process the contractual relationship with you.

Your right to block your data: In certain legally defined cases, we will block your data if you so wish. Blocked data will only be processed to a very limited extent.

Your right to revoke consent: You can revoke your consent to the processing of your data at any time with effect for the future. The legality of the processing of your data until the revocation remains unaffected.

Your right to object to the processing of your data: You can object to the processing of your data at any time with effect for the future if we process your data on one of the legal bases according to Art. 6 Paragraph 1 Letter e or f of Regulation (EU) 2016/679. If you object, we will stop processing your data unless there are compelling legitimate reasons for further processing. We never have compelling legitimate grounds when we process your data for direct marketing purposes.

Your right to data portability: At your request, we can provide you with certain data in a structured, common, and machine-readable format.

Your right to lodge a complaint with the supervisory authority: You can also lodge complaints about data protection with a data protection authority. To do so, contact the data protection authority responsible for your place of residence or the data protection authority responsible for us.
